1.THE CONTRACT
The Contract for a short term holiday rental will be between The Edge Owners (referred to as “us” or “we”) and the person making the booking and all members of the holiday party (referred to as “you” or “your”) under the following booking conditions. UK law will govern the Contract. The contract of hire is not effective until the deposit has been paid, a completed online booking form has been received by us and confirmation of booking has been despatched by us to you. The contract will be subject to these booking conditions, and must be complied with. The party leader must be at least 18 years of age at the time of booking and prior to arrival we must be provided with a list containing the names and ages of all guests.

2. PAYMENT
Bookings are confirmed upon receipt of the deposit of 30% of the holiday cost. The deposit must be paid within 5 days of the booking being placed, otherwise your provisional booking will lapse. The balance of the rental will be due for payment 6 weeks prior to the holiday commencement date and we reserve the right to cancel a holiday where payment has not been received six weeks before the commencement date. If the booking is made within six weeks of the holiday start date the full rental payment will be required. If the booking is made within 14 days of the arrival date, full payment must be received within 24 hours of placing the booking. No entry to the property will be allowed without payment, in full, being cleared beforehand. Once you have a confirmed booking, you are responsible for the full rental cost even if you subsequently cancel. All payments including the separate Security Deposit of £350 are to be paid by Direct Bank Transfer. The separate Security Deposit is security against damage/breakages and must be paid at the same time as the final balance. The Security Deposit will be refunded within 14 days of departure subject to deductions necessary by reason of your or any member of your party’s breach of your obligations in clauses detailed in these Terms and Conditions.

3. CANCELLATION
In the event of you being unable to take your holiday, you should inform us immediately in writing by email and by phone, and once received in writing we will confirm the cancellation request. We will retain your non-refundable booking deposit and you will remain responsible for payment to us of the total cost of your booking. We therefore strongly advise you to take out holiday insurance to cover you for the full cost of the stay. If we are able to re-let your booking we will refund you the letting price less an administration fee of £50. If we are unable to re-let there will be no refund under any circumstances and you will still be responsible for the full rental cost.
Accommodation is non-transferable unless permission is given by the Owner.

4. INSURANCE
Cancellation Insurance is not compulsory but we strongly recommend such insurance to protect against the cancellation penalty.
Insurance covering your personal belongings, medical cover and your 3rd party liabilities are also strongly recommended. We accept no responsibility for loss, injury or damage howsoever arising.

5. CIRCUMSTANCES BEYOND THE CONTROL OF THE OWNER (INCLUDING FORCE MAJEURE)
If for any reason we have to cancel your booking in advance due to circumstances beyond our control for example war, civil strife, fire, flood, exceptional weather conditions, epidemics, destruction/damage to the property , you will be refunded the full amount of the booking. If we have to terminate your holiday early for the above reasons you will be refunded the appropriate proportion of the Holiday Rental attributable to the then unexpired remainder of the Holiday Period from the point of determination. You shall have no further claim against the owner and no additional compensation, expenses or costs will be payable. In the event of cancelling your holiday before you arrive or during your stay we have no obligation to assist you in finding an alternative Holiday or accommodation.
The Edge (Owners) cannot accept responsibility for loss of utility services which include water, power and telecommunications that occur through no fault of the Owners. The Owners will of course use their best endeavours to get services reconnected.
Every effort will be made to ensure the standard described for the property and that all items of equipment described and supplied by the owners are in good working order. However, no guarantee is given or liability accepted if any breakdown occurs. Repairs are always effected as soon as possible, although inevitably delays do occur.

6. PERIOD OF HIRE
You should not arrive before 4pm on the commencement date, and the property must be vacated by 10am on the day of departure. Failure to do so may result in you being charged a further day’s rental. You must not use the property except for the purpose of a holiday during the holiday period, and not for any other purpose or longer period. The agreement to stay in the property for the holiday period, does not create the relationship of Landlord and Tenant between the parties. You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the Holiday Period.

7. NUMBER OF PERSONS USING THE PROPERTY
Under no circumstances may more than the maximum number of persons stated on the booking form occupy the property. We reserve the right to refuse admittance if this condition is not observed.

8. LIABILITY
The Edge (owners), shall not be liable to you or your party for any accident, loss or damage to property howsoever arising. Please be aware that The Edge is positioned on a cliff edge. Do not venture off the balconies or the sections of the garden clearly demarked by paving slabs or chipping stones. All children are the responsibility of the accompanying adults when staying at The Edge and must be supervised at all times. You must take all necessary steps to safeguard yourselves and your property.

9. CARE OF THE PROPERTY
You are responsible for the property and are expected to take all reasonable care of its furniture, pictures, fittings, kitchen equipment, crockery, glasses, bedding and towels, in or on the property. You must leave them in the same state of repair, and in a reasonable clean and tidy condition at the end of the rental period. The Owner reserves the right to make an extra charge for cleaning if the property is not left in a satisfactory condition.
You must not use the properties for any dangerous, offensive, noxious, noisy, immoral activities or carry on there any act that may be a nuisance or annoyance to the owner or other neighbouring properties.
Smoking or vaping is not allowed in or on the property.
You are responsible for placing any rubbish from your stay in the correct bags and location as specified in the information pack within the Edge. We reserve the right to pass on any charges resulting from the incorrect disposal of rubbish at a £25 administration cost.

10. ACCOMODATION
The Booking price includes bed linen and towels (1 hand and 1 bath towel per person). Beds are supplied with a duvet and 2 pillows per person.
Fixtures, fittings and furnishings are subject to change and improvements over time.

11. VEHICULAR ACCESS & PARKING
You acknowledge that you have read and understood the separate Access Statement which can be found on our web-site. Beacon Road is exceptionally narrow in places and many modern sized cars cannot fit down it to reach The Edge.
We strongly advise on your arrival stopping on Church Hill at the junction with Beacon Road and walking on foot first to familiarise yourself with the narrowness of the road before deciding to progress or not.
The Edge’s garage itself can accommodate a small to medium sized car, should you wish to use it during your stay. However, turning into and out of the garage can be difficult, especially if cars are parked opposite so parking on the street is certainly your easiest option. There is free parking on Beacon Road, although spaces cannot be guaranteed.
During your stay, we accept no liability for damage to your vehicle whatsoever or for fixed penalty notices for unlawful parking infringements.

12. DAMAGES & BREAKAGES
The Tenant is liable for the full cost of any damage caused to or within the property during the letting. By accepting these terms and conditions you agree to pay for any damages with the cost of any damage being invoiced to the Tenant on or as soon after departure as possible by the Owner.
Any damage, breakage, or anything else giving cause for concern noticed on taking occupancy of the property, must be reported within 24 hours to the owner or caretaker.

13. WIFI
Wi-Fi is provided for the guests’ reasonable use. The guest agrees to reasonable and lawful usage of this service.

14. RIGHT OF ENTRY
We shall be allowed, with notification, the right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance, causing as little inconvenience to you as reasonably practicable and making good any damage caused to the Property and your property.

15. COMPLAINTS
Every effort has been made to ensure that you have an enjoyable stay. However, if you have any problem or cause for complaint, it is essential that you contact us immediately to give us the chance to resolve it. We value your custom and want you to return.

16. DRONES AND FIREWORKS
Neither are permitted.

17. OUTDOOR FIRES AND BARBEQUES
Neither are permitted.

18. PETS
Domestic pets and non-domestic animals/birds are not allowed over the boundary of the property. Where tenants bring pets without consent, they will be asked to remove the pet from the property immediately and the security deposit will be deemed forfeit.

19. LOST PROPERTY
Any articles left behind by the tenant can be forwarded on receipt of a minimum handling fee of £10 plus postage deducted from the security deposit. Any unclaimed articles will be disposed of after 28 days.
